How to transfer an existing premises licence from one licence holder to another.
Sections 42 to 46 of the Licensing Act 2003 regulate the transfer of premises licences.
What you must provide
- An application form
- The existing premises licence, or if not available a statement why the licence cannot be returned
- A copy of a document showing your right to work in the UK, such as a British/EU passport, visa
- Consent from the current premises licence holder
- The fee
- Full copy of the application and any accompanying documents must be sent to the police and the Home office

Photocopies are not accepted. Cheques should be made payable to Rushmoor Borough Council.

What happens once we receive your application
As soon as we receive your application, we will allocate it to one of our licensing officers who will check to ensure that the application is valid and has been submitted to the police.
If there is a problem with the application
If there is a minor problem with the application, we may contact you for further information or may return the notice to you for correction. Where there is a fundamental error, the application may be rejected.
Objections by the police
If they have concerns about crime and disorder, the Police may object to the application (within 14 days). In such cases we will hold a hearing to make a decision.
If we don't receive any objections
We will send the transferred licence to you.
How long it takes to process transfer applications
We aim to process transfer applications within 28 days of receiving them (or sooner if the police raise no objection). However, you can ask that your transfer takes immediate effect from the date that we receive it.
